Message:  A song title can not be copywritten. Arrangements of public domain songs can be copywritten but I'm not sure of the exact requirements for how much has to be changed. The prime example of this, of course, is "American Trilogy".
The writer of a song has the "right of first refusal" to who gets to record it. That means the writer can decide who does it first. (Mickey usually did his own songs first after the early days.) But once a song is recorded then anyone can record it without needing permission. Of course they must pay a fee for each CD made.
